How often does an I-9 need to be reverified?

Employers are required to reverify an employees documentation only when the employees employment authorization document (EAD) or receipt has expired. Reverification should occur no later than the actual expiration date of the work authorization.

Why is my employer asking for an I-9 again?

If you present employment eligibility documents that have expiration dates, the employer will write those dates on the I‑9 form. On or near those dates, the employer may ask you again to present documents that show you are still eligible to work.

Is it illegal to work without an I-9?

Yes. While citizens and noncitizen nationals of the United States are automatically eligible for employment, they too must present the required documents and complete Form I-9, Employment Eligibility Verification.
