An Order to Show Cause consists of a top page called an Order to Show Cause (OSC), followed by an Affidavit in Support of the OSC, and copies of any documents that the moving side (movant) thinks would help the Judge make a decision. The OSC tells the court and the other side what the movant wants the Judge to do.
NATURE OF ACTION OR PROCEEDING CPLR 3402(a) requires an original an two copies must be filed within 10 days of service upon the other side. There is also a fee to file the note of issue.
There is a process for making a motion without giving notice. This type of motion is called an Order to Show Cause. This alternative motion does not have to wait eight days and can be heard at any time the court directs. In real emergencies, the court may even hear a motion in a matter of hours.
If you are the Respondent (a petition was filed against you) and you fail to appear as ordered, the judge may take your default and grant the petition without further hearings. Sometimes the court can have people arrested if they do not come to court when they are told.
You should submit a request for court records directly to the Clerk of the Court or the County Clerk that possesses those records. Typically, the court in which the case was handled will have those records.
You must submit original answering papers to the court with original affidavits of service at the time and place indicated in the Notice of Motion or Order to Show Cause. Your answering papers should be written in a clear, concise, and organized manner.
What is a Notice to Show Cause? A notice to show cause is a formal document issued to one party in a dispute. It sets out details of an alleged offence or misconduct. In doing so, the receiving party will have the chance to explain themselves or otherwise face some further consequences.
Notices of appearance are typically filed by counsel for defendants who have not previously responded to the complaint or otherwise appeared in the action.
