Commonly Asked Questions about Custody agreement Canada Forms

If one parent takes or keeps a child under 14 years of age away from the other parent without the others consent, he or she may be charged with parental child abduction (kidnapping) under the Criminal Code of Canada. It doesnt matter if there is a Canadian court order of custody (parenting arrangements) or not.
Generally, an unmarried parent who has the care and control of the child is considered the sole custodian without having to go to court. This is usually the mother of the child. A court may order otherwise if there is a child custody case to be heard.
Since the Divorce Act was enforced on March 1, 2021, Canadian law has shifted towards a focus on shared parenting when determining custody arrangements. This means that both parents are presumed to have an equal right and responsibility to participate in the upbringing of their children.
To start a new court case, you always have to fill out Form 8: Application (general) in addition to the form that your case is about. For example, if you have to go to court to start a case about child custody and access, you would fill out Form 8 and Form 35.1 Affidavit in Support of Claim for Custody or Access.
In Canada, if unmarried fathers can prove their paternity, they have the same legal rights as any other parent and can be involved in their childs life. The same goes for couples who live together but arent married and have a child together they are seen as joint custodians.
Do I have a say in who my ex brings around my child? You dont have a say in who the parent brings around your child unless you have a court order stating otherwise. If the person doesnt pose a safety risk, you shouldnt restrict the child from visiting the other parent.
Only very narrowly defined circumstances provide grounds for a judge to restrict parental rights and award full or sole custody to one person. A parent or other guardian petitioning for full custody must prove that the other parent is unfit and cannot fulfill the best interests of the child.
