The Lacey Act (16 U.S.C. 3371 et seq., the Act) as amended makes it unlawful to import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce any plant, with some limited exceptions, taken or traded in violation of the laws of the United States, a U.S. State or a foreign country.
Who is allowed to file a Lacey Act declaration? Only the Importer of Record (IOR) or their agent (e.g., a customs broker) may sign the Lacey Act declaration form (PPQ Form 505) or file a declaration in the LAWGS data system or the Automated Commercial Environment.
APHIS, the National Marine Fisheries Service, and the U.S. Fish and Wildlife Service administer the Lacey Act. APHIS is responsible for collecting declarations for imported plants and plant products, and defining the scope of plant materials that require a declaration.
PPQ Form 587: Application for Permit to Import Plants or Plant Products. This permit is for the importation of admissible (not subject to post-entry) plant material from foreign sources. The application is submitted to USDA and not subject to review by CDFA.
This amendment applies to lumber imports from outside of the United States and will affect a number of products, including paper, plywood, furniture, and other wood products.

USDA PPQ FORMS This permit application is for the importation of live plant pests from within the United States and from foreign countries. The applicant completes the application and submits it to the United States Department of Agriculture (USDA). USDA notifies CDFA of the application and provides a copy for review.
Plants must be accompanied by a phytosanitary certificate from the country of origin showing that the plants meet entry requirements for the United States. Plants should be bare rooted (no growing media attached to the roots). You should perform a basic visual inspection of plants.
Under the Lacey Act, importers are required to provide a Lacey Act declaration for certain plants, including plant products, in order for these commodities to be imported into the U.S. This required information is collected and used by APHIS to prevent the illegal harvesting and trading of these commodities.
You are required to file a Lacey Act declaration if CBP considers your importation a formal entry. Some musical instruments contain protected plant material listed in Appendices I and II of the Convention on International Trade in Endangered Species (CITES).
APHIS' Plant Protection and Quarantine (PPQ) program safeguards U.S. agriculture and natural resources against the entry, establishment, and spread of economically and environmentally significant pests, and facilitates the safe trade of agricultural products.
