Compliance with the Lacey Act revolves around due diligence, which requires companies to collect data to be certain about the origins of their products and materials. To comply with the Lacey Act, companies must first assess if any imported goods or products contain plant material, including wood.
The Act also did not prohibit trade in plants taken in violation of foreign law. However, in 2008, the Lacey Act was amended (Food, Conservation and Energy Act of 2008, section 8204) which included the prohibition of trade in plants and plant products, such as timber and paper, harvested in violation of foreign law.
