Demand for Possession, Nonpayment of Rent A demand for possession for nonpayment of rent is used when a tenant has not paid the rent and the landlord wants the tenant to either pay the rent or move out or vacate the premises.
Before your landlord can evict you for not paying your rent, your landlord must give you a Demand for Possession, Nonpayment of Rent. This is the first step in the eviction process. The demand must: Be in writing. Be addressed to the tenant.
Starting the Court Case Once you get a demand for possession, you have seven days to pay the rent or move out. If you dont do either one, your landlord can start an eviction case against you.
The judge must sign the Order before its valid. It tells a court officer, such as a sheriff or sheriffs deputy, to remove you and your belongings from the home, and gives your landlord possession of the home. A judge can only issue an Order of Eviction after a judgment is issued.
