To get an order of protection, you must allege that the abuser committed one or more family offenses against you. The following crimes are considered to be family offenses when the victim and abuser are/were related by blood, marriage, in an intimate relationship, or they have a child in common: Disorderly conduct.
If a final order of protection is issued, this occurs at the end of the case after the Judge finds that a family offense was committed or the respondent agrees. A final order lasts for two or five years.
A protective order (EPO/TIPO) is effective until the court hearing is held, usually within 14 days. If the respondent has not been served with the EPO/ TIPO, the order will be continued until service is made (up to six months) or until the order is withdrawn by the court.
In law, intervention is a procedure to allow a nonparty, called intervenor (also spelled intervener) to join ongoing litigation, either as a matter of right or at the discretion of the court, without the permission of the original litigants.
