VAWAs housing protections, in part, are available to someone who has previously or is currently experiencing domestic violence, sexual assault, dating violence, or stalking. VAWA protects all survivors, and the survivor does not have to be married to, related to, or living with the perpetrator to be protected by VAWA.
This is possible, even without filing an adjustment of status application. Getting an I-360 VAWA petition approved does not guarantee that you will receive a green card. You may have inadmissibility issues that prevent USCIS from approving your adjustment of status application.
VAWA does not cover private, market-rate housing unless your landlord accepts your Section 8 voucher. Otherwise, private landlords do not have to follow the protections explained in this section.
Ineligibility due to background and criminal history: Serious criminal history or prior violations of immigration law could result in your applicants being deemed inadmissible for a VAWA Green card. Drug crimes, certain moral crimes, and fraud may disqualify an applicant.
