Crimes that cannot be expunged in Pennsylvania include violent crimes and sexual offenses, among others. When the courts expunge a conviction or charge, the court is removing it from the record or sealing the record from the public.
Summary convictions will be sealed after 5 years. Eligible misdemeanor convictions can usually be sealed after 7 years without another misdemeanor or felony conviction. Eligible felony convictions can usually be sealed after 10 years without another misdemeanor or felony conviction.
When the case is complete, you will receive a copy of an order that is signed by the judge. The order instructs all relevant agencies to expunge any records of the case. It is important to know that ARD cases that were successfully completed after April 1, 2013 should automatically be expunged by the court.
