How long does it take to win a Cancellation of Removal case? Currently, approximately four years for non-detained cases. If you are detained and unable to get released on bond, you may only have a few months to prepare your case. There are two reasons for the very long delay.
You can do one of two things: 1). Apply in the court that issued the order of deportation, for the court to vacate or cancel the order of deportation; or 2). Apply with the Immigration Service to waive or cancel your former order of deportation.

If the immigration judge approves cancellation of removal, you will be able to obtain a green card, also known as lawful permanent residence.
To apply for suspension of deportation under former section 244 of the Immigration and Nationality Act (INA), you must fully and accurately answer all questions on the attached Form EOIR-40. A separate application must be prepared and executed for each person applying for suspension of deportation.
