It is possible your business may have a third-party located abroad continue to market with CEMs on your companys behalf to others outside of Canada. CASL technically only applies to CEMs sent or received in Canada.

Under CASL, consent is required before sending a CEM. Yet, an electronic message that is sent to obtain consent to send a message for commercial purposes is also considered a CEM. Consent can either be express or implied. Express consent means someone actively gave you permission to send him/her a CEM.
CASL applies to all CEMs that are sent or received in Canada. However, as an exception to his general rule, it is ok to send a CEM to someone if you have a reasonable belief that the CEM will be accessed in another country that has its own laws regulating CEMs.
