Notice of Determination/Ruling (DE 1080CZ) This notice advises employers of EDDs decision about a claimants eligibility for UI benefits. It provides a reason for the decision, the applicable section code of the UI law, charges to the employer reserve account, and appeal rights.
Under the provisions of Section 1260(a), once a VQ or MC disqualification is assessed, the claimant must return to work and earn five times his or her weekly benefit amount in bona fide employment and reopen the claim. The disqualification will remain in effect until the requirements have been met.
In California (as in every other state), you can appeal a denial of unemployment benefits. If you win your appeal, you will receive all benefits to which you are entitled, including retroactive benefits from the date your application should have been accepted in the first place.
