Landlords can legally evict tenants with a One Month Notice to End Tenancy (PDF, 2.1MB) RTB Form 33 for not following legal responsibilities under the tenancy agreement or Residential Tenancy Act (RTA).
Fixed term tenancy: you can only terminate by notice at the end of the term of the tenancy, and you must give at least 60 days notice from the end of the term. For example, if you have a year-long tenancy agreement that started on October 1, 2003, you must give notice on or before July 31, 2004.
If you do not give a notice to terminate your tenancy, your tenancy automatically renews and you can stay in the unit as a month-to-month tenant.
Landlords are required to give their tenant at least 60 days written notice to the end of the term or rent period using the Landlord and Tenant Board Form N12.
Tenants are legally allowed to break a lease early in Ontario if the tenant is a victim of sexual or domestic violence, to be admitted to a care home, or if the landlord fails to provide legal requirements in terms of providing a livable habitation for tenants.
You must give your landlord at least 28 days notice and the termination date must be the last day of a rental period. So if your rent is due each Monday, your termination date must be a Sunday. You must give your landlord at least 30 days notice. Your termination date can be any day you choose.
The end of a fixed term tenancy or lease does not mean that the tenant has to move out or sign a renewal or new lease in order to stay. The lease is renewed automatically on a month-to-month basis (if the rent is paid monthly) or week-to-week basis (if rent is paid weekly).
