Commonly Asked Questions about Installment Agreements

An installment contract is a single contract that is completed by a series of performancessuch as payments, performances of a service, or delivery of goodsrather than being performed all at one time. Installment contracts can provide that installments are to be performed by either one or both parties.
The penalties under an installment agreement are also less, which saves the debtor money. As an added bonus, the debtor can choose to pay the balance in full once it becomes more manageable, without incurring additional fees or penalties.
Background. Each tax assessment has a Collection Statute Expiration Date (CSED). Internal Revenue Code (IRC) 6502 provides that the length of the period for collection after assessment of a tax liability is 10 years. The collection statute expiration ends the governments right to pursue collection of a liability.
Most taxpayers qualify for an IRS payment plan (or installment agreement) and can use the Online Payment Agreement (OPA) to set it up to pay off an outstanding balance over time. Once taxpayers complete the online application, they receive immediate notification of whether the IRS has approved their payment plan.
There are two types of Streamlined Installment Agreements, depending on how much you owe and for what type of tax. For both types, you must pay the debt in full within 72 months (six years), and within the time limit for the IRS to collect the tax, but you wont need to submit a financial statement.
6 years - If you dont report income that you should have reported, and its more than 25% of the gross income shown on the return, or its attributable to foreign financial assets and is more than $5,000, the time to assess tax is 6 years from the date you filed the return.
This plan gives them an extra 180 days to pay the balance in full. Long-term payment plan (also called an installment agreement) For taxpayers who have a total balance less than $50,000 in combined tax, penalties and interest. They can make monthly payments for up to 72 months.
