Exact wording of existing Rule: Rule 205. DISCOVERY FROM NONPARTIES. 205.2 Notice. A party seeking discovery by subpoena from a nonparty must serve, on the nonparties and all parties, a copy of the foi of notice required under the rules governing the applicable foul, of discovery.
Fact witnesses testify as to events or facts about which they have personal knowledge. These witnesses are paid a statutorily established rate of $40 per day plus reasonable amounts for travel and certain other costs associated with their appearance in court.
TRCP 176.5: A subpoena must be served by a sheriff, constable, or any person who is not a party and is at least 18 years of age by delivering a copy to the named person. Agency legal staff or designated contact: Evaluate the subpoena to determine next steps (see next slide).
(a) Witness Fees. Upon the subpoenaed witnesss appearance at the hearing, the party that issued the subpoena shall tender a witness fee check or money order in the amount of $10 to the witness, unless the witness waives the fee. (b) Travel Reimbursement.
If a subpoena requires you to attend court to give evidence, the person serving the subpoena must give you conduct money sufficient for return travel between your place of residence or employment (as appropriate) and the Court. The amount of conduct money must be at least $25.

Pursuant to the United States Code, all witnesses in federal cases or before a U.S. Magistrate Judge are required to be compensated a per-day fee of $40, as well as 58.5 cents per mile to and from the location of the deposition or courthouse. See U.S. Code 1821.
(a) Contempt. Failure by any person without adequate excuse to obey a subpoena served upon that person may be deemed a contempt of the court from which the subpoena is issued or a district court in the county in which the subpoena is served, and may be punished by fine or confinement, or both.
