The lemon law covers vehicle nonconformities. A nonconformity is defined as a vehicles failure to conform to all express warranties applicable to such vehicle, which failure substantially impairs the use, market value or safety of that vehicle.
To Qualify Under the Utah Lemon Law The vehicle must have been purchased in the state of Utah. The vehicle must be new and under warranty. The vehicle must be a car or truck weighing less than 12,000 pounds, or a motor home. The defect must substantially impair the use, market value or safety of the vehicle.
What can affect a lemon law claim? Nature of the defect. New or used vehicle. Statute of limitations. Proof of repair attempts. Quality and skill of your attorney.
There is NO three-day right to cancel or rescind an automobile purchase. Once you purchase a vehicle, you assume responsibility for it. Some sellers may have policies allowing for the return of a vehicle within a determined time period, but this is decided by the seller and is NOT required by law.
The law allows you to file suit any time within three years of the date of the original delivery of the vehicle, if you first reported the defect within the warranty period, or two years, whichever comes first. If you go through a manufacturers arbitration program, you have six months to appeal in court.
