Use the correct percentage of total income CSSA says should be devoted to child support: 17% for one child. 25% for two children. 29% for three children.
In New York State, a child is entitled to be supported by his or her parents until the age of 21. However, if the child is under 21 years of age, and is married, or self-supporting, or in the military, the child is considered to be emancipated and the parents support obligation ends.
For one child, you take 17% of the parents combined income, for two children you take 25%, for three children you take 29%, for four children you take 31% and for five children you take no less than 35% of the parents combined income and this percentage amount represents the basic child support obligation.
Either parent may be eligible to stop a child support order if they can check at least one of the boxes:  The parent who owes child support is incarcerated with no chance of parole or is institutionalized.  Custody of the child has changed.
There are a few ways to file: Visit the Family Court where your court order was issued and complete a Support Petition for Modification form (also known as form 4-11). Call the Family Court where your child support order was issued and they will mail you the Support Petition for Modification form.
