Regulation (EC) No 2201/2003 known as The Brussels IIa Regulation is a single legal instrument aiming to help international couples resolve disputes, involving more than one country, over their divorce and the custody of their children.
COUNCIL REGULATION (EC) No 2201/2003 of 27 November 2003 (Brussels II bis) sets out rules on jurisdiction and the recognition and enforcement of judgments in matrimonial matters and in matters of parental responsibility.
article 8 allows for the transfer of jurisdiction to another contracting state where a court with jurisdiction considers a court in another contracting state is better placed to hear the case. Article 15 of Brussels IIa allows for the same. article 11 gives jurisdiction to contracting states in urgent cases.
Changes and effects yet to be applied to Article 39: The competent court or authority of a Member State of origin shall, at the request of any interested party, issue a certificate using the standard form set out in Annex I (judgments in matrimonial matters) or in Annex II (judgments on parental responsibility).
The Brussels II Regulation came into force on 1 March 2001 and regulated jurisdiction and the recognition and enforcement of judgments in matrimonial matters (divorce, legal separation, marriage annulment itself) and in matters of parental responsibility for joint children.
