The Certificate of Closed Pleadings is the form to get your case onto the list of cases that are ready for a trial. The Certificate of Closed Pleadings may be filled out by either party in the case when the pleadings are closed.
The order of pleadings shall be as follows: (1) The plaintiffs complaint. (2) The defendants motion to dismiss the complaint. (3) The defendants request to revise the complaint. (4) The defendants motion to strike the complaint.
However, if a counterclaim, cross-claim or third-party claim is interposed, the pleadings are closed when an answer to a counterclaim, cross-claim or third-party complaint is filed, except in the cases of a court-ordered reply to an answer.
These three letters are followed by two letters that tell the type of case: civil (including housing and small claims)(CV); or family (FA). The next two numbers represent the year the case was filed, followed by the seven digit docket number.
If the case has not been disposed of through interlocutory motions, within 10 days after the pleadings are closed, either party must file a certificate of closed pleadings, which notifies the court that the matter is ready for trial. A case may be scheduled for trial at any time by order of the court.
