There are three ways to get emancipated: Get legally married. In California, anyone under 18 must have a parents permission and get permission from the court to get married. Join the military. If you are under 18, you must have permission from your parent and the military. Get a court order saying you are emancipated.
For example, as soon as a person turns 18 years of age, they legally become an adult, and is emancipated from their parents. In addition, if a minor legally gets married, they become emancipated. Finally, a minor may become emancipated by the Juvenile Court.
The requirements for emancipation vary by state. Minor emancipation laws vary by state, but some state courts charge a filing fee of between $150 and $200. You must file the petition with the court and notify your parents or legal guardians (required by most states). Then the court will schedule a hearing date.
Can you move out at 16 or 17 in Indiana? Minors cannot move out without parental or court approval until they are 18.
There may be other situations in which the parent and/or child may want to seek court approval of their agreement. As the legal procedure is not clear cut, it can be difficult to pursue. There are no court-approved forms. You certainly will need the help of an attorney.
