If a school is found to have violated FERPA by improperly releasing records, denying access, or failing to allow corrections it can face serious consequences, including the loss of federal funding. However, FERPA doesnt give you the right to sue your school directly.
A FERPA violation occurs when a school or its staff fails to protect the privacy of a students education records. This usually involves the unauthorized disclosure of personally identifiable information (PII) from these records to a third party without the students or parents consent.
Because parochial and private schools at the elementary and secondary levels generally do not receive funding under any program administered by the US Department of Education, they are not subject to FERPA. Private postsecondary schools, however, generally do receive such funding and are subject to FERPA.
Sharing a students grades without consent, whether by posting them publicly with identifiable information or sharing with individuals not authorized to access the records, violates FERPA. For example, this can happen when a professor posts a list of student grades on a bulletin board using names or ID numbers.
