Allocation of Parental Responsibilities is the legal process in family court to obtain physical and legal custodial rights for a minor child. There are three main areas of responsibilities addressed in an APR case: decision-making, parenting time, and child support.
A case for the allocation of parental responsibilities has two parts: decision making and parenting time.
The responding party shall have 21 days after the date of service of a motion, or such lesser or greater time as the court may allow, in which to file a response. The moving party may file a reply no later than 14 days after the date of service of the response, or such lesser or greater time as the court may allow.
Colorado law puts mothers and fathers on equal ground when it comes to child custody. This is true even when children are very young at the time of divorce or separation. So, in theory Colorado's child custody laws (known as Allocation of Parental Responsibilities) are gender-neutral.
Parental kidnapping, or custodial interference, is the crime of knowingly taking a child away from the person who has lawful custody. In most cases, it is a Class 5 felony in Colorado. The line between parental kidnapping and a minor custody violation, though, is murky under Colorado law.

People also ask

What is sole custody? Colorado does not have joint custody or sole custody. Colorado uses the term parental responsibility \u2013 which can either be joint or primary. If you equally share in overnight visitation with the minor child, you have joint parental responsibility.
Requesting Emergency Child Custody To start the process, you should file a motion in court. This motion must allege that the child is endangered under CRS 14-10-129(4) and include sufficient factual allegations to support the charge. A barebones accusation that a child is endangered is rarely adequate.
What it means to file a motion: A motion, in its simplest form is a list of requests that you are asking the Court grant on your behalf. You, or your attorney on your behalf, will file a Notice of Motion which includes a list of requests for the court to rule upon.
Usually, the child must have lived in Colorado for 6 months (182 days) before a case can be filed. But, there may still be custody options if the child has not lived in Colorado for 6 months. To learn more, please contact a Navigator. If parents file an APR case together, they are known as Petitioner and Co-Petitioner.
These include: to protect your child from harm. to provide your child with food, clothing and a place to live. to financially support your child. to provide safety, supervision and control. to provide medical care. to provide an education.
