Witness Subpoena: The Subpoena Ad Testificandum is the most common type of subpoena. It compels a person to appear and testify as a witness in a legal proceeding. Unlike the Subpoena Duces Tecum, it does not request the production of documents or evidence.
In this jurisdiction, there are two (2) kinds of subpoena, to wit: subpoena ad testificandum and subpoena duces tecum. The first is used to compel a person to testify, while the second is used to compel the production of books, records, things or documents therein specified. As characterized in H.C.
A subpoena is an Order that is issued to require the attendance of a witness to testify at a particular time and place. A subpoena duces tecum is an Order that requires a witness to bring documents, books or other items under his, her, or their control, that he she or they is bound by law to produce into evidence.
(a) Subpoenas ad testificandum. Counsel for a party may sign and issue a subpoena, on a form provided by the Secretary, requiring a person to appear and give testimony at the taking of a deposition to a party requesting such subpoena or to attend and give testimony at an adjudicative hearing.
A federal subpoena ad testificandum is a legal document that compels a person to testify as a witness in a legal proceeding, such as a trial, grand jury, deposition, or hearing.
