The owner may always build a residential building on Clean and Green land. Also, buildings that are necessary for agricultural production may be built on lands enrolled in Clean and Green.
The State Department of Agriculture has provided this document to give you a general overview of the Program . Enrolled land is taxed at its use value rather than fair market value, and can result in an average reduction of 50% in its assessment.
What Land is Eligible for Enrollment in Clean and Green? To be eligible for enrollment in the Clean and Green program, land must be devoted to one of the following three qualifying uses: agricultural use, agricultural reserve use, or forest reserve use.
On July 6, 2005, Act 38 also known as ACRE (Agriculture, Communities and Rural Environment) went into effect to ensure that ordinances adopted by local governments to regulate normal agricultural operations are not in violation of state law. A local ordinance cannot exceed, duplicate or conflict with state law.
The tracts must usually be at least 10 acres in size and continue to meet the qualifications.
