The term derives from Latin tortum, meaning something twisted, wrung, or crooked. The concept encompasses only those civil wrongs independent of contracts.
This chapter addresses the four intentional torts, assault, battery, false imprisonment, and intentional infliction of emotional distress, that involve injury to personswhat some call the dignitary torts.
Tort came into English straight from French many centuries ago, and it still looks a little odd. Its root meaning of twisted (as opposed to straight) obviously came to mean wrong (as opposed to right).
For example, a practical joker who thinks it would be funny to tell someone that an accident has caused serious injury or death to a family member does not cause a physical injury. Yet, the law holds the prankster liable for the devastating psychological impact of such a cruel joke.
The word tort comes indirectly from the Latin term tortus, which means crooked or twistedin other words, wrong. It therefore makes sense that a tort is a civil wrong that occurs where someone unfairly causes another person to suffer loss or harm.
