Before party wall building works can start, the homeowner (Building Owner) needs a written Party Wall Agreement from all affected neighbours (Adjoining Owners). Or, a surveyor has to be appointed to prepare a Party Wall Award (the agreed document outlining how the works should progress).
What is the Party Wall Act 3 metre rule? The Party Wall act covers excavations within 3 metres of an Adjoining Owner, if the lowest point of the excavation will be lower than the underside of the footings to the party wall (or parts of their property which are within three metres of the proposed excavation).
The surveyor will arrange a Party Wall Award, setting out details of the work. The Party Wall Award is a legal document setting out what, how and when work can be carried out and who will pay for it (including surveyors fees).
Whilst more unusual, there can be legal involvement if there is no party wall agreement in place. This can be varying degrees of legal involvement (and costs) and can include Court injunctions, stopping the party wall works for an indefinite period.
