The quickest way to get a divorce in Arizona is for the parties to first file for divorce in Arizona and agree on all of the terms of their divorce. You or your attorney will draft the proper settlement documents and submit those documents to the court.
To get divorced in Arizona, at least one spouse must have lived in the state for 90 days before filing, and the marriage must be irretrievably broken (except in covenant marriages). Arizona is a no-fault divorce state, meaning you dont need to prove wrongdoing by either party.
Technically, the judge has up to 60 days to issue his or her ruling or order. Normally, you can expect to be divorced in about 90 days total. If there are no children involved, you do not have to go to a hearing. If one or more children are involved, you may be required to go to at least one hearing.
Even though Arizona does not require a separation period before a couple can divorce, the state still has a waiting period. A couple must wait at least 60 days after filing the divorce petition before the court can finalize the divorce by issuing a divorce decree.
Section 32B allows for divorce by mutual consent after a minimum separation period of one year. In contested cases, if the grounds for divorce are desertion, then two years of desertion is required to claim matrimonial relief.
