HOW DO YOU STAKE A MINING CLAIM? Find an area of interest. Your first step will be to determine where to search for mineral deposits. Conduct a land status search. Map your location and determine your claim type. Stake the ground. File Notice of Location(s). Pay Your Fees.
Mining claims that are not recorded with the BLM do not give you any rights to federal minerals. Federal unpatented mining claims may be either active or closed on BLM records. A closed mining claim gives you no rights.
(1) An individual placer claim may not exceed 20 acres in size. (2) An association placer claim may not exceed 160 acres.
New Claim Staking Fees September 2024 As of September 1, 2024, the cost for new claims is $274 for lode claims, tunnel sites, and mill sites. This fee breaks down into a $25 processing fee, $49 location fee, and a $200 maintenance fee. This fee must be paid within 90 days of the date of claim location.
To record a mining claim, the claimant must file a copy of the location notice of the claim in the recorders office in the county which the claim lies and with the BLM State Office in Sacramento within 90 days of the location of the claim. The mining claim must be on Federally administered land open to mineral entry.
