The landlord must give the tenant notice and go through the court process to get an Eviction Order.
In Illinois, if there is no lease or if the lease does not specify a move out date, the Landlord must give at least 30 days of notice to a tenant that the landlord wants to move out. This notice must be in writing and must arrive to the tenant at least 30 days prior to their move out date.
If the tenant pays the rent within those 5 days, then the eviction process does not continue. If the tenant is unable to pay, the landlord reserves the right to continue with the eviction process.
Note: The notice does not need to be notarized before it is given to the tenant. If your tenant does not obey the notice, or has not moved out when the notice period ends, you can file a case to evict the tenant. Do not file your case before the notice period is up.
