The Jury Act provides examples of potential grounds for exemption such as: over age 65, hardship, religion, and language barriers. However, individuals may request an exemption for any number of reasons.
Individuals over the age of 65 and those who have served on a jury within the last two years can be excused. Requests from other individuals may also be considered if they would suffer personal or financial hardship as a result of jury duty or if they are ill or otherwise incapable of performing their duties.
Those chosen are then sent a letter in the mail (called a jury summons), which gives the time and place to appear. Under section 38(3) the Ontario Juries Act, failure to return the questionnaire, or providing false information, are offences punishable by a fine of up-to $5,000 and/or up-to six months in jail.
