When a party is found in contempt of court, the court can impose a variety of sanctions. These can include fines, jail time, and even the loss of parental rights. The court may also order the party to pay the other partys attorneys fees and court costs.
In California, the injured party must file an Order to Show Cause and Affidavit for Contempt to receive this type of judgment. The party must have proof of a broken valid court order a court order about which the offending party has knowledge.
(5) If the defendant is found guilty of contempt of court under this section, the court may impose for each separate contempt of court a fine of not more than five thousand dollars or imprisonment for up to three hundred sixty-four days, or both.
Any court, including a family support magistrate, may punish by fine and imprisonment any person who in its presence behaves contemptuously or in a disorderly manner; but no court or family support magistrate may impose a greater fine than one hundred dollars or a longer term of imprisonment than six months or both.
