The California Constitution gives the Governor the authority to grant clemency, which includes commutations of sentence and pardons.
Someone currently in state custody and anyone with a conviction on their record can potentially apply for clemency, but they will generally need to be patient. The Governor has the authority to grant a reprieve, commute a sentence or outright pardon someone for a prior criminal conviction.
Any person making a request for clemency must first have their application processed by the Board of Parole in what is called a screening. This will determine if there is any merit to the application. A victim can only make written recommendations to the Board of Parole during this step of the process.
To apply for clemency in California, the applicant must: Notify the District Attorney (D.A.) of the county in which the offender was charged and sign an affidavit declaring that they did so. Complete and send a signed application of clemency to the Governor.
The California Constitution gives the Governor the authority to grant clemency in the form of a pardon, commutation, or reprieve. In cases where the applicant has more than one felony conviction, the Governor must first get the approval of the Board of Parole Hearings and the California Supreme Court.
