To start the eviction case, fill out 4 court forms: Summons - Unlawful Detainer-Eviction (form SUM-130) Complaint - Unlawful Detainer (form UD-100) Plaintiffs Mandatory Cover Sheet and Supplemental Allegations Unlawful Detainer (form UD-101)
If a tenant fails to pay rent, you must serve them a 5-Day Notice to Quit. This will give the tenant five days to pay the rent due or move out of the property. If the tenant doesnt begin paying rent or moving out within five days, you can go to court and file an eviction lawsuit.

The Landlord must give a 5 day Notice to Vacate. That is five business days, exclusive of holidays. At the end of that period, if the tenant is still in possession, the Landlord may file a Petition of Eviction.
