What is the new probation law and are there exceptions? AB 1950 amends Penal Code Section 1203a by reducing the maximum term of probation for most misdemeanor crimes to one year. It also amends Penal Code Section 1203.1 to reduce the maximum term of probation for most felonies to two years.
AB 1950 capped probation for many misdemeanors at one year, and for many nonviolent felonies at two years. Those caps do not apply to violent crimes such as robbery, or ; to crimes for which specific probation periods are already spelled out in the law; or to certain theft or financial crimes.
Misdemeanor probation, which is also called informal probation or summary probation in California, is typically shorter at one to three years. However, in some cases, summary probation may last as long as five years, like formal probation.
