Additionally, some states do require advance directives to be notarized.
A Power of Attorney appoints someone else to make decisions on your behalf, whereas an ACD sets out your wishes directly to your medical treatment providers should you be unable to communicate what those wishes for medical treatment are.
You must sign your Durable Power of Attorney document in front of either a notary or two witnesses. The two witnesses cannot be a health care provider in your home or long- term care facility nor can they be related to you by blood, marriage or state registered domestic partnership.
The document must be witnessed and signed by two individuals, in the presence of a notary; The person who will hold the durable power of attorney (the agent), must be designated; and. The health care directives to be followed should be clearly set forth.
Note: Washington state requires this directive to be witnessed by two people or acknowledged by a notary public. WITNESS REQIREMENTS: The witnesses to this document must be competent and must NOT be: \u2022 Related to you by blood or marriage.
