Proposition 47, also known as the Safe Neighborhoods and Schools Act went into effect on November 5, 2014. This Act reduces most drug possession offenses and thefts of property valued under $950.00 from felonies to misdemeanors.
Those who have completed their sentence can apply to the trial court to have the felony conviction or convictions designated as a misdemeanor if he or she would have been guilty of a misdemeanor under this act had this act been in effect at the time of the offense.
There is no statewide form to apply for Prop 47 relief. Check with the court where the conviction occurred to find out if there is a local form. If no form is available, you may write your own request and file it with the court. You will need to show the court a good cause why you missed the filing deadline.
Prop. 47 does NOT give you back your gun rights. Even if your felonies are reclassified, it will still be a crime for you to own or possess a gun.
