I-800A, Application for Determination of Suitability to Adopt a Child from a Convention Country. USCIS uses this form to adjudicate the eligibility and suitability of the applicant(s) who want to adopt a child who habitually resides in a Hague Adoption Convention country.
The adult adoption process includes an in-person consultation with an attorney, preparation of a petition for adoption and any accompanying legal documents based on the facts of the case, and attendance at least one hearing in Maryland and the District of Columbia.
Adoption Petition: The stepparent must file an adoption petition in the family court of the county where they reside. The petition includes relevant information about the child, the biological parents, the stepparent, and their relationship. These adoptions are filed in the Family Court, which is a user friendly court.
Form I-600 is used for non-Hague Adoption cases, while the Form I-800 is used for Hague Adoption cases. Filing either Form I-600 or I-800 tells USCIS that you have identified a specific child to adopt and request authorization for that child to come to the United States.
Approximately 75 days after filing you will receive notice from Citizenship and Immigration Services Office as to approval of your application. If you have been approved you will receive a Notice of Favorable Determination Concerning Application for Advance Processing of Orphan Petition.
The form you use depends on the foreign country from which you would like to adopt. For a Convention country, file Form I-800A. (A Convention country is a party to the Hague Adoption Convention.) For a country not party to the Hague Adoption Convention, use Form I-600A.
U.S. citizens who plan to adopt an orphan from a non-Hague Convention country use this form to request that USCIS determine their suitability and eligibility as prospective adoptive parents.
