In California, the Department of Alcoholic Beverage Control (the ABC) has the exclusive power to license and regulate the manufacture, importation and sale of alcoholic beverages and to revoke any alcoholic beverage license for good cause. Article XX Section 22 of the California Constitution.
Police officers, sheriffs deputies, and ABC Agents are all sworn law enforcement officers (peace officers) with powers of arrest. Whether in plain clothes or uniform, peace officers have the legal right to visit and inspect any licensed premises at any time during business hours without a search warrant.
The caterer must have a license obtained from the State of California Department of Alcoholic Beverage Control which enables the caterer to sell beer, wine and distilled spirits (hard liquor). If the caterer does not have this license, the private party cannot sell alcohol. No exceptions.
➢ Special Event permit(s) may only be issued for a period of up three (3) consecutive days ➢ Additional applications must be submitted for events lasting more than 3 days. ➢ Wholesalers may ONLY deliver alcoholic beverage products up to two (2) days prior to event address as indicated on special event permit.
