Property owners must obtain relocation permits from the Florida Fish and Wildlife Conservation Commission (FWC) to relocate all gopher tortoises before any land clearing or development activities can take place. Rule 68A-27.003 (F.A.C.)
In Florida, gopher tortoises are a protected species, and it is illegal to take them from the wild without a permit. If you find a baby gopher tortoise alone, the best course of action is to leave it in its natural habitat.
