Gopher Tortoise Permits The Conservation permit is available for development projects which require the relocation of gopher tortoises when more than 10 burrows occur on the development site. This permit allows for relocation off-site to a FWC-permitted Recipient Site.
The gopher tortoise is protected in all states where it occurs (state-listed as threatened in Louisiana, Mississippi, Georgia, and Florida; state-listed as endangered in South Carolina; and protected as a non-game species in Alabama).
Before developers can begin clearing land, they must obtain permits from the Florida Fish and Wildlife Conservation Commission (FWC) to survey, capture and relocate the tortoises. While this sounds fair enough, doing so is a lengthy and expensive process that can cost up to $8,000 or more per animal.
The U.S. Endangered Species Act makes it illegal to harass, collect, or harm tortoises and provides for penalties of up to $50,000 in fines and one year in prison for each count. State laws and Fish and Game Codes also afford protection to the de- sert tortoise.
Florida law prohibits any person from killing or wounding gopher tortoises, which are protected as threatened in the state. Violating the law is a third-degree felony and punishable by up to five years in prison, a $5,000 fine or both.
