The AWWS allows employees and management to mutually agree upon a work schedule that varies from the standard eight (8) hours per day, five (5) days per week work schedule. An AWWS does not alter the total number of hours worked per work week.
The alternative workweek may not require more than 10 hours of work per day and no more than 40 hours of work a week without overtime compensation. Any overtime between 10 and 12 hours worked above the alternative workweek established in the agreement must be paid at 1.5 times the regular rate of pay.
If employers hold elections that follow strict rules, an employer can institute an alternative work schedule such as The Nine-Eighty (9/80) Schedule; The Four-Ten (4/10) Schedule (10 hours per day for 4 days per week), and, The Three-Twelve (3/12) (12 hours per day for 3 days per week).
An alternative workweek is defined as any regularly scheduled workweek requiring an employee to work more than eight hours in a 24-hour period.
The election to repeal the alternative workweek schedule shall be held not more than 30 days after the petition is submitted to the employer.
