It is the duty of the guardian to protect and preserve the estate of the ward and provide an annual accounting of the guardians dealings with the wards assets to the court.
Guardianship provides for the persons care and management of their money while preserving, to the largest extent possible, that persons independence and right to make decisions affecting their life. Texas courts have the authority to appoint a guardian with full or limited authority over an incapacitated person.
The guardians authority will be greater than your own. No matter what kind of agreement you make with the potential guardian ahead of time, you will not be able to override the guardians decisions. Even though you are the parent, the guardian will have all the authority to make decisions about your child.
A guardian of the person has control over the wards personal matters, such as housing, medical, and educational decisions. A guardian of the estate has control over the wards property and finances. One person can serve as both a guardian of the person and of the estate.
Under Texas law, a Guardian of the Person with full authority has the right to have possession of the ward and establish the wards residence. The guardian also accepts the duty to provide care, supervision, and protection for the ward as well as to provide them with food, clothing, medical care, and shelter.
