The first step in the New Hampshire guardianship process is to file a Petition for Guardianship with the probate court in the county where your parent is a resident. The Petition must be served on the proposed ward (your parent) as well as close family members, all of whom may object to the appointment of a guardian.
The guardian may be appointed over the person and also over the persons estate. There are generally two types of guardianships: guardianship of a minor and guardianship of an incapacitated person.
New Hampshires law allows any competent person to be appointed guardian, provided there is no conflict of interest. A bank or trust company can be appointed guardian of the estate.
