Public Act 260 PA 260 protects the taxable value on farmland from rising to the State Equalized Value (SEV) when farm property is transferred, so long as the land remains an agricultural use.
To qualify for agricultural assessment: Must have 7 acres or more of land in production for sale of crops, livestock or livestock products. The same farmer must farm the land for at least 2 years. Farming enterprises must generate $10,000 in sales (average for the preceding 2 years)
In order to qualify for the exemption, owners of parcels that are not classified agricultural must file an affidavit, Form 2599, claiming the exemption with the local assessor by May 1. An assessor will use the status of the land on May 1st in making their determination for qualification.
There is no minimum acreage required in order for your property to be considered a farm.
To become a tax-exempt farm, you must apply for special permits or submit certain forms to your local taxing entity or the IRS.
