Being made a ward of the court means the court takes over primary responsibility for the control and treatment of a minor. In finding a wardship, the court must consider: the age of the minor, the circumstances and gravity of offenses committed by the minor, AND. the minors previous delinquent history.
Courts deem children state wards when they lack a capable parent or guardian to provide supervision. Minors need protection because of their age. They require a parent or guardian to ensure they have housing, food, clothing, and education.
In California, a juvenile offender may be ordered to be a ward of a court if such juvenile violated any state law, curfew, or from excessive truancies since the juvenile criminal justice system in California is geared toward rehabilitation instead of punishment.
A wardship disposition happens when the court declares a youth a ward and places the youth on formal probation under the control of the Probation Department.
The prominent difference between the following types of probation is non-wardship vs wardship. Non-wardship probation does not allow the Probation Department to remove the juvenile from their home. Wardship Probation means that the Court has jurisdiction over the minor as if the Court was the minors parent.
