The Code contains time limits for making an application to the HRTO . You must file your application within one year of when the alleged discrimination happened.
There are no fees at the HRTO.
In order to respond to an application, a respondent must file, unless the HRTO orders otherwise, a Response (Form 2) with the HRTO no later than thirty-five (35) days after a copy of the application was sent to the respondent by the HRTO.
The Human Rights Tribunal is where human rights applications are filed and decided. The Human Rights Legal Support Centre gives legal help to people who may have experienced discrimination under the Ontario Human Rights Code.
Parties can expect to wait between four and 10 years to get to a hearing. Out of the 40 substantive evidentiary decisions released by the HRTO in 2023/24, all but two of the applications were filed between 2014 and 2020. Six decisions were on applications filed between 2014 and 2016.
