If a tree or wood is protected by a TPO or is in a conservation area, anyone wishing to carry out management work - including pruning or removal - will need to get permission from the local planning authority (usually the local council).
A Tree Preservation Order is made by the council, giving legal protection to trees or woodland. They prevent trees being cut down, uprooted, topped, lopped, wilfully damaged or destroyed, including cutting roots, without our permission. Their purpose is to protect trees for the public to enjoy.
You cant cut down Live Oaks, Southern Magnolias, Bald Cypresses, or Eastern Red Cedars without a permit. These trees are considered heritage trees due to their size, age, or species. Live Oaks are cherished for their broad-spreading crowns and longevity.
It is a criminal offence to cut down, top, lop, uproot, wilfully destroy or damage a tree in a manner likely to destroy it, without our consent, and, on summary conviction, you could be fined up to 20,000 (and on conviction on indictment, to an unlimited fine).
Removing a tree (or trees) from your property as a preventative measure will not be covered by your homeowners policy. It is a good investment for peace of mind, but tree removal is an out-of-pocket expense in this case.
