An applicant can always take their chances in responding to a Final Office Action without filing an RCE. The risk, however, is that such an after-final response may not place the application in condition for allowance.
Note that an RCE is only proper if prosecution in the application is closed (e.g., the last Office action is a final action, a notice of allowance, or an action that otherwise closes prosecution in the application).
An RCE is a request for continued examination, which allows the applicant to continue to pursue a utility patent on an application for which the United States Patent and Trademark Office has closed prosecution. Filing an RCE requires an additional fee, similar to the initial filing fee.
