Note: A motor carrier may file an ELD malfunction extension request via email, by submitting the extension request to ELD-Extension@dot.gov or the FMCSA Division Administrator for the State of the motor carrier's principal place of business. The request must include the information required by § 395.34(d)(2).
Guidance: A driver should only use paper logs, electronic logging software, or other electronic means to record their hours of service if the ELD malfunction hinders the accurate recording of the driver's hours of service data (i.e., 10/11, 14/15, 60/70 hours; or 30 minute).
Starting December 16, 2019, all carriers and drivers subject to the ELD rule must use ELDs.
The ELD rule allows limited exceptions to the ELD mandate, including: Drivers who operate under the short-haul exceptions may continue using timecards; they are not required to keep RODS and will not be required to use ELDs. Drivers who use paper RODS for not more than 8 days out of every 30-day period.
