Time served is a term colloquially used by courts when imposing a sentence that is deemed to be completely satisfied by the defendants previous time spent in custody while awaiting sentencing.
Time served relates to how long you were detained between being convicted and being sentenced. i.e. youve been found guilty, but we havent decided your punishment yet. Were holding you until that court date. You get credit for the time you spend in pre-trial detention.
So, if you spent for example 6 months waiting for your trial and/or sentencing dates, and your final punishment is only 6 months in jail or less, your sentence would be: Guilty, time served because you already spent the required amount of time in jail just waiting for your court dates.
You may be eligible for Credit caused by Time Served if you were incarcerated while serving a sentence for another offense if the confinement occurred after the commission of the misdemeanor for which the defendant is now being sentenced.
